1. Acceptance of Terms
By accessing or using the 5Squares website (5squares.com), ordering portal (orders.5squares.com), or any related services (collectively, "the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a binding agreement between you and 5Squares LLC ("5Squares," "we," "us," or "our"), a New York limited liability company located at 1 North Avenue, New Rochelle, NY 10805.
2. Eligibility
You must be at least 18 years of age to place an order or create an account. By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete.
3. Our Service
5Squares is a meal preparation and delivery service. We deliver freshly prepared meals to your home on a subscription basis. Meals are delivered Sunday through Thursday nights, covering the following day's meals.
We offer multiple plan types including our Signature Plan, Paleo, Pescatarian, and Gluten-Free options. Plans are available 2 to 7 days per week. We reserve the right to modify menu offerings, ingredients, and plan structures at any time.
4. Account Registration
To place an order, you must create an account through our ordering portal. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@5squares.com if you suspect unauthorized use of your account.
5. Orders and Subscriptions
Your subscription will continue on a recurring basis based on the plan you selected until you cancel in accordance with Section 7 of these Terms.
By placing an order, you authorize us to charge your payment method on the schedule associated with your plan. We may update pricing from time to time and will notify you in advance of any change that affects your active subscription.
6. Payment
We accept Visa, MasterCard, and American Express. All charges are in U.S. dollars. You represent that you are authorized to use the payment method you provide.
If a payment is declined or fails, we reserve the right to suspend delivery until payment is resolved. We are not responsible for any fees your bank or card issuer may charge in connection with your payments to us.
7. Cancellation and Modifications
To cancel your subscription, we require a minimum of 3 delivery days' advance notice. Cancellation requests must be submitted by email to info@5squares.com. Upon processing your request, we will confirm your final delivery date.
Cancellations received with less than 3 delivery days' notice may result in a charge for those remaining deliveries.
To modify your plan — including changing the number of days, meal selections, or dietary preferences — contact us at info@5squares.com or through your account portal. Modifications are subject to the same 3 delivery day notice window.
We do not offer refunds for meals already prepared or delivered.
8. Delivery
Deliveries are made overnight, Sunday through Thursday, to the address on file for your account. Meals are packed in an insulated cooler bag with ice packs and left at your front door.
You are responsible for ensuring a secure, accessible drop location. If you reside in a building without a doorman, a key or access code may be required for entry.
5Squares is not liable for meals that are damaged, stolen, or spoiled as a result of an inaccessible or unsecured drop location, or failure to retrieve your delivery in a timely manner.
Delivery availability is subject to your location and may change. We will notify you if we are unable to service your address.
9. Dietary Restrictions and Allergies
We make reasonable efforts to accommodate dietary preferences and common food exclusions. However, our meals are prepared in a shared kitchen environment, and we cannot guarantee the absence of any specific allergen.
If you have a life-threatening food allergy, we strongly advise against enrolling in our program. By placing an order, you acknowledge and accept this risk.
It is your responsibility to review meal contents and inform us of any restrictions or allergies. We are not liable for adverse reactions resulting from undisclosed allergies or conditions.
Nothing in our program constitutes medical or nutritional advice. Consult a qualified healthcare provider before starting any new diet or nutrition program.
10. Cooler and Equipment
An insulated cooler bag is provided for delivery. This equipment remains the property of 5Squares. Upon cancellation, you may schedule a cooler pickup or retain it for future use. Failure to return equipment in a timely manner upon request may result in a replacement charge.
11. Intellectual Property
All content on the Site — including text, images, logos, and menu materials — is the property of 5Squares LLC and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or use our content for commercial purposes without our express written permission.
12. Prohibited Conduct
You agree not to:

Use the Service for any unlawful purpose

Attempt to gain unauthorized access to any part of the Site or our systems

Submit false, misleading, or fraudulent information

Interfere with the operation of the Service or other users' access to it
13. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We make no warranty regarding the accuracy or completeness of any content on the Site.
14. Limitation of Liability
To the fullest extent permitted by law, 5Squares LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, personal injury, or property damage.
Our total liability to you for any claim arising out of these Terms or your use of the Service shall not exceed the amount you paid us in the 30 days preceding the claim.
15. Indemnification
You agree to indemnify and hold harmless 5Squares LLC and its members, officers, employees, and agents from any claims, losses, or damages — including reasonable legal fees — arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Westchester County, New York, and you consent to personal jurisdiction in those courts.
17. Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we will update the "Last Updated" date above. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
